The Commission's simplification drive arrives with genuine promise for RegTech innovation — but the gaps it leaves open may prove more consequential than the burdens it lifts.
The EU's Digital Omnibus on AI, published by the Commission on 19 November 2025, arrives at a critical juncture. Financial institutions across the bloc have spent years quietly building out AI-powered compliance stacks — transaction monitoring engines, adverse media screeners, customer risk scoring models — only to find themselves staring down an AI Act whose implementation timeline and compliance architecture threatened to make much of that investment legally precarious. The Omnibus was supposed to fix that. To a limited degree, it does. But for professionals working at the intersection of AI and financial crime compliance, the picture is considerably more complicated.
This analysis examines the Omnibus through that specific lens: what it actually changes for RegTech vendors and compliance teams deploying AI in AML, sanctions, fraud, and KYC functions; where it genuinely opens space for innovation; and where it leaves gaping silences that the financial crime community must now navigate without a map.
01 What the Omnibus Actually Does — A Realistic Assessment
The headline change — a delayed and conditional application of high-risk AI rules — is perhaps the most immediately significant for the financial sector. Under the original AI Act, many AI systems deployed in credit risk, fraud detection, and customer due diligence are likely to fall within Annex III's scope. The Omnibus now ties the application of those rules to the availability of harmonised standards and compliance tools, with a hard backstop of December 2027 for Annex III systems.

The removal of mandatory AI literacy obligations for providers and deployers — replaced by a softer Commission-level promotion of literacy initiatives — is a notable reduction in operational burden. In practice, large financial institutions had already absorbed literacy requirements into their model risk management frameworks; for smaller RegTech firms and fintechs, the original obligation would have been disproportionate. The shift to a policy-level responsibility is pragmatic, even if civil society organisations are right to flag it as a weakening of accountability.
The sandbox expansion: a quiet breakthrough
Arguably the most underappreciated provision in the Omnibus for financial crime compliance is the expansion of AI regulatory sandboxes. The proposal grants the AI Office a legal basis for establishing an EU-level AI regulatory sandbox, and broadens the scope for testing high-risk AI systems in real-world conditions. For anti-money laundering technology specifically, this matters enormously: the fundamental challenge in developing better transaction monitoring and network analysis tools is access to labelled, real-world financial data without triggering data protection violations or confidentiality obligations.
A well-designed EU-level sandbox — particularly one that enables cross-border, multi-institution data collaboration under supervised conditions — could unlock the kind of federated learning environments that the AML-AI community has been demanding for years. The provision is enabling, not self-executing; whether it delivers will depend entirely on how the AI Office chooses to operationalise it.
Bias detection and special category data: a double-edged provision
The Omnibus also permits, on an exceptional basis, the processing of special categories of personal data — including racial or ethnic origin, religion, and health data — for bias detection and correction in AI systems. This is a significant shift from the previous framework, which confined this permission to high-risk AI systems only.
For financial crime compliance, this is genuinely consequential. Demographic bias in transaction monitoring is one of the field's most persistent and under-acknowledged problems: models trained on historical SAR data systematically over-flag certain communities, and correcting for that bias requires exactly the kind of sensitive attribute data that was previously off-limits. The provision creates a lawful pathway — subject to safeguards including deletion of data once bias has been corrected — that responsible compliance technology developers have long needed.
The risk, acknowledged by the EDPB and EDPS in their joint opinion, is that "exceptional basis" becomes standard practice without adequate supervisory scrutiny. The financial sector, given its history with data governance failures, should be building internal guardrails well ahead of any regulatory requirement to do so.
02 The Centralisation Question: AI Office Supervision and What It Means for FinCrime AI
The Omnibus consolidates supervision of AI systems integrated into very large online platforms and AI systems where the model and system are provided by the same entity under the EU AI Office. This is presented as a simplification — a single point of regulatory contact rather than fragmented national oversight. For financial crime technology, the picture is more nuanced.
Most RegTech vendors sit outside the "very large online platform" category. Their primary regulatory interlocutors remain the national competent authorities designated under the AI Act — except that, as the Omnibus itself acknowledges, many of those authorities remain undesignated. This creates an oversight vacuum that the centralisation provisions do not resolve. A transaction monitoring solution deployed across a European banking group faces a compliance landscape where it is simultaneously subject to AI Act high-risk obligations, national AML supervisor expectations, EBA guidelines on ML/TF risk management, and the forthcoming AMLA framework — with no single authority able to provide authoritative guidance on where those frameworks conflict.

03 What the Omnibus Does Not Do — The Critical Gaps
The Omnibus's stated purpose is simplification of the AI Act's implementation, not wholesale reengineering of the EU's approach to AI in regulated sectors. That scope limitation is legitimate. But it means the framework leaves several problems that are specifically acute for financial crime compliance entirely unaddressed — and in some cases makes them harder to solve by removing pressure for resolution.
Extended timelines for high-risk AI rules, sandbox expansion, conditional bias data processing, reduced literacy obligations, single conformity assessment applications, SME regime extension to small mid-caps.
Sector-specific explainability standards, cross-border data collaboration frameworks for AML purposes, interoperability mandates between compliance AI tools, harmonised evidence standards for AI-generated suspicious activity indicators, and a regulatory pathway for ensemble/federated models.
The explainability gap remains wide open
Financial crime compliance operates under a legal architecture that requires not just accurate outputs but auditable, explainable decision pathways. When a suspicious activity report is filed on the basis of an AI-generated risk score, the compliance officer signing that report must be able to articulate — to a national FIU, to a court, to a regulatory examiner — why the system flagged the underlying activity. The AI Act's transparency requirements for high-risk systems are designed to address this, but the Omnibus's delay in applying those requirements, combined with the absence of harmonised documentation standards, pushes that resolution back by at least 18 months.
More critically, the Omnibus provides no mechanism for sector-specific explainability guidance. The financial crime community needs standards that are calibrated to its actual use cases: what does adequate explainability look like for a network analysis model identifying shell company structures? What human oversight obligation applies when a real-time payment screening system auto-blocks a transaction? These questions cannot wait for general harmonised standards; they need financial sector-specific technical specifications developed jointly between the EBA, AMLA, and the AI Office — a coordination mechanism the Omnibus does not establish.
Public-private data sharing: the absent framework
The single most consequential enabler of effective financial crime AI — and the single most conspicuous absence from the Omnibus — is a legal framework for structured public-private information sharing at scale. The UK's Joint Money Laundering Intelligence Taskforce (JMLIT) model, and similar mechanisms in the Netherlands and Singapore, demonstrate that when banks can share typology data and case information with one another and with law enforcement under a structured legal safe harbour, the detection capability of AI models improves dramatically.
The EU's AMLA regulation creates new channels for supervisory data sharing, but it does not resolve the fundamental barrier: under current GDPR interpretation and national AML law, a Spanish bank cannot share its ML typology dataset with a German bank to collaboratively train a joint detection model, even where both are under the same banking group supervision. The Omnibus's sandbox expansion gestures in this direction but creates no substantive safe harbour. A fit-for-purpose framework would require coordinated amendment of the AMLA Regulation, GDPR guidance from the EDPB, and technical specifications for privacy-preserving federated learning — none of which are on the current legislative agenda.
SME provisions miss the RegTech reality
The extension of simplified documentation and penalty considerations to small mid-caps is presented as a win for smaller innovators. For RegTech firms specifically, it is largely illusory. The compliance burden for a RegTech vendor is not primarily driven by its own corporate size — it is driven by the size and risk appetite of its clients. A ten-person AML analytics startup deploying models inside a systemically important bank faces conformity assessment expectations set by that bank's regulator, not by the startup's own balance sheet. The Omnibus does not address this fundamental asymmetry, and in practice the due diligence and contractual requirements that large financial institutions impose on AI vendors will continue to function as the de facto compliance standard regardless of what the Omnibus says about SME treatment.
04 What the Financial Crime Compliance Community Should Be Demanding
The Omnibus is not the end of the legislative process; it is, as the Commission acknowledges, the first step in a broader digital simplification agenda. The second step — a wider fitness check of the EU's digital rulebook — is currently in consultation. That creates a window for the financial crime compliance and RegTech community to shape what comes next. A credible agenda should include at least the following.
- Sector-specific technical standards: The EBA, in coordination with the AI Office, should develop binding technical standards for explainability, data governance, and human oversight specific to AI systems in AML, sanctions, and fraud functions — not waiting for cross-sector harmonised standards that will arrive too late and be too generic to be actionable
- A federated AML data infrastructure: Building on the sandbox provisions, the EU should establish a dedicated federated learning infrastructure — modelled partly on the European Health Data Space — that enables privacy-preserving model training across institution boundaries under AMLA and EDPB joint oversight
- GDPR and AMLA joint guidance on AI use: The EDPB and AMLA should issue joint guidance resolving the specific conflicts between data minimisation obligations and AI-based monitoring requirements — including guidance on synthetic data generation as a compliance pathway
- Procurement-level interoperability standards: The European Banking Authority should require that AI compliance tools procured by obliged entities conform to interoperability standards that allow supervisors to audit model behaviour across institutions — addressing the current fragmentation where each bank runs proprietary black-box systems that cannot be benchmarked against sector peers
- AI evidence standards for SAR filings: FIUs, working through Egmont Group and EU channels, should develop guidance on the evidentiary standards for suspicious activity reports that incorporate AI-generated risk indicators — providing legal certainty for both filers and prosecutors
Verdict: A Necessary but Insufficient Step
The Digital Omnibus on AI is best understood as a pressure-release valve for an AI Act whose implementation architecture outpaced its supporting infrastructure. For financial crime compliance specifically, it offers genuine relief in a few areas — timeline extension, sandbox expansion, bias data processing — while leaving the most structurally significant challenges entirely intact.
The risk is that the reprieve encourages complacency. The delay in high-risk rules does not make AI systems in AML and fraud any less high-risk; it simply defers the moment of reckoning. Compliance technology firms and the financial institutions deploying their tools would be better served by treating the Omnibus window as time to build proper governance frameworks, not time to defer the problem.
The deeper structural work — interoperable data infrastructure, federated learning safe harbours, sector-specific explainability standards, coherent AMLA-AI Act coordination — remains entirely undone. The fitness check consultation is the next real opportunity to demand it. The financial crime compliance community should use it.
